Products & Services Terms, Conditions, and Policies Agreement

1. Gift Certificates: Hot air balloon ride and biplane ride gift certificates are not redeemable instruments, they are only for the purpose of conveying a gift of a flight to the recipient and need not be presented at the time of flight. All certificates are issued with an expiration date of one year (365 days) from the date of issue. This date only requires that the recipient attempt to schedule the flight at least once during the year the certificate was issued to keep the certificate from expiring. Certificates DO NOT EXPIRE as a result of weather postponement. Expired certificates, that were never scheduled, may be reactivated for a $25 dollar fee, per passenger or for any change in pricing that may have occurred (whichever is greater).

2. Scheduling: It is the passenger's responsibility to contact Light Flight Balloons, Inc. to schedule their flight. We recommend four to six weeks notice to ensure that you have as many schedule day options as possible. Generally, weekdays book one week in advance and weekends are two weeks in advance for balloon flights and one week in advance for the biplane rides. Don't hesitate to call on short notice as availability is based on unpredictable demand and we are often able to accommodate passengers on short notice. Failure to schedule a balloon flight within the twelve (12) months following its purchase will result in a certificate being considered expired. Balloon flights may be scheduled year round. Biplane certificates must be scheduled during the six (6) months of the year, May thru October, that the biplane operates or those certificates will be considered expired.

3. Weather Rescheduling: Light Flight Balloons, Inc. shall be solely responsible for determining whether flying conditions are suitable or not. Passengers are not permitted to make cancellations based on their own weather parameters or to demand that a flight take place on a particular day. See our weather page for specific criteria on suitable and unsuitable flying conditions. A weather check telephone call to passengers will be made by Light Flight Balloons for all balloon flights. Biplane flights are not as weather dependent and biplane passengers will only receive a telephone call if flights are canceled. The weather check call for a morning balloon flight will be made between 8 p.m. and 9:30 p.m. the night before the flight. Evening balloon flight weather check calls will be made between 2 p.m. and 3:30 p.m. (prior to daylight savings time) on the day of the flight. After daylight savings time, the evening or afternoon weather check will be provided 2-3 hours prior to the scheduled meeting time. These times are not arbitrary, they coincide with the release of aviation forecasts. If you do not receive a weather check call for a scheduled flight, it means that we have had some difficulty reaching you at the number provided or we do not have you scheduled to fly; call and let us know where you may be reached. Weather rescheduled passengers may incur price increases if the cost of a ride changes from the time that they originally booked the flight to the time they actually take the flight unless at least four (4) attempts to fly are made in all twelve (12) month periods from the date of the original purchase. Because of the vagaries of weather, there are no guarantees for visibility, altitude, lighting conditions, or that a flight will occur in a given geographic area. The duration of balloon flights may be altered to be shorter or longer than advertised to safely conduct the flight and to accommodate weather and suitable landing site availability.

4. Transfers: Certificates are fully transferable to another passenger at no cost. Light Flight must be notified in writing of the desire to transfer a flight to another person by the original purchaser. Certificates are also interchangeable between the hot air balloon and biplane rides. If you receive a balloon flight and wish to apply the amount of the account to the biplane, and vice versa, you may do so at no additional cost. Transfers do not extend the expiration date and all other terms remain with the certificate or ride.

5. Refunds: All purchases are refundable within six (6) months of purchase less Fifteen (15%) percent. This amount covers the administrative and credit card processing fees charged to Light Flight Balloons, Inc. for both the original booking and the refund. Purchases made more than six (6) months prior are not refundable.

6. Cancellations: A minimum of 72 hours notice is required for all flight cancellations to avoid being charged fees or incurring the forfeiture of certificates. Passengers must notify Light Flight Balloons, Inc., by telephone of a cancellation at 410-836-1116. You must receive confirmation from Light Flight Balloons that the flight has been canceled either by telephone or by e-mail to ensure that we have received your cancellation in a timely fashion. If you cancel a flight with less than 72 hour notice, we will attempt to find replacement passengers or you may have someone else take the flight in accordance with paragraph 8. Cancellation of a scheduled flight with less than 72 hours notice and with no suitable replacements, will result in the forfeiture of the flight, any certificate/s, all monies paid, and any balance owed on the account will be charged.

7. No Shows & Late Arrivals: Failure to show for a flight or a late arrival at the meeting location or airfield, which causes a passenger/s to miss the flight or our departure for a launch site, will result in the forfeiture of the flight, any certificate, all monies paid, and any balance owed on the account will be charged. In the case of balloon flights, the meeting time is based on sunset or sunrise times with no latitude for time; you must be on time to the meeting location as we will leave there promptly for a launch site. The safety of the flight, the ability to provide the advertised duration, and the accommodation of other passengers are the reason for this requirement; we must be airborne at a specified time to accomplish these goals. Allow sufficient time for unforeseen circumstances to be on time. If a balloon flight permits, we will endeavor to have the crew retrieve late arriving passengers in an effort to save their flight. There is no guarantee that this can or will occur; if the crew is required to return to the meeting location or any other location to pick up passengers, there will be a surcharge of $25.00 added to the cost of the flight.

8. Passenger Requirements: Passengers under the age of 8 are not permitted aboard a non-tethered balloon flight. Passengers under the age of 14 must be accompanied by an adult. Passengers under the age of 18 require a parental or legal guardians signature to fly. Light Flight Balloons, Inc. must be informed of any physical handicap, disability, the age, and approximate weight of all passengers at the time of booking a flight. Passengers in excess of 270 pounds or under the age of nine (9) cannot fly in the airplane. If you desire to change a passenger on a flight, we must be notified prior to meeting passengers to fly. Last minute changes will be accommodated at the sole discretion of the pilot and only if the change does not affect the flight planning, i.e. a significant increase in passenger weight. Any change that cannot be accommodated will require the original passenger to fly or the policy on cancellations will apply. Unless you specifically booked a Private Balloon Charter, there may be other passengers aboard your flight. All balloon private charter and thirty minute flights must be specifically requested at the time of booking. Failure to specify either a private charter or a thirty minute flight will result in the passengers being booked for a standard one hour charter. Consumption of alcoholic beverages is prohibited aboard any flight and on the launch site or airfield. Intoxicated or drugged passengers, in the opinion of the pilot, will not be permitted aboard a flight and the full fare will be charged in accordance with the cancellation policy in paragraph 6.

9. Passenger Safety Briefing & Release Form: All passengers and spectators are required to participate in a Balloon Safety Briefing and all passengers must sign an Assumption of Responsibility and Risk Agreement, Release, Waiver, & Medical Statement. 10. Half-Hour Balloon Flights, Balloon Second Flight Passengers, and 20 Minute Biplane Rides: In an effort to make balloon flights available to more people and to take advantage of suitable weather, Light Flight Balloons will often schedule double flights. A double flight is where we fly one set of passengers, land, switch fuel and passengers and take off again for a second flight in the same balloon. There is no difference between the actual ride in the balloon; second flight passengers must ride in our chase van during the first flight and this adds one hour to the total experience. This affords an opportunity to photograph the balloon in flight from the ground while experiencing the "chase." First ride passengers may elect to "chase" the balloon by riding along with the crew on the second flight or be taken back to their vehicle at the conclusion of their ride. All flights are always booked first come, first served; you will be informed at the time of booking if you are on the second flight of a double flight. Half-hour flights are always scheduled as second flights. We must have a full complement of half-hour flight passengers to conduct a half-hour flight; passengers may be rescheduled if a full complement is not available, at the discretion of Light Flight Balloons. Flight times and dates may be blacked out for half-hour balloon flights. Twenty (20) minute biplane rides must be grouped with another flight or flights for a total of one (1) hour in order to be scheduled. If no other flights are scheduled that day, the flight may be rescheduled at the discretion of Light Flight Balloons. This is done to ensure that the airplane's engine oil gets to an adequate temperature for longevity - any combination of flight time that is less than one hour is insufficient to do so.

11. Billing, Payment of Fees, Interest Rates, and Collections: A written flight confirmation may indicate that your credit card has been charged when it has not; we batch process credit card payments and depending upon when you book your flight, it may process that day or up to 14 days later. The same is true of refunds made by credit to a charge card, they may process immediately or up to 14 days later. Biplane flights are paid in full at the time of purchase. Balloon flights require a $100.00 per passenger deposit for our thirty minute and champagne charter flights at the time of booking; the balance is due at the time of flight. Private charters require that 50% of the charter fare be paid at the time of booking. If a credit card is declined for any reason whatsoever at the time of booking, any subsequent method of payment must be for the full amount; including another charge card which will be authorized for the full amount of the flight. Any payment made by a check that is dishonored by the drawee bank, for any reason whatsoever, will incur an additional fee of Twenty-Five Dollars ($25.00) or ten percent (10%) of the amount of the check, whichever is greater. The customer agrees to the charging and payment of simple interest at the rate of eighteen (18%) percent per annum, and one and one-half (1.5%) periodic rate for all balances over thirty (30) days. If Light Flight Balloons, Inc. must refer the customer's account to an attorney for collection, the customer shall pay on demand all court costs and expenses of collection including actual attorney's fees incurred by Light Flight Balloons, Inc., whether or not any lawsuit is filed. The customer waives the issuance and service of process and confesses a judgment in favor to Light Flight Balloons, Inc. for the amount of the bill, plus interest, together with the cost of the suit thereon including the aforesaid attorney's fees.

   The Intellectual Property Rights in this website and the materials on or accessible via it belong to Light Flight Balloons, Inc. or its licensors.    You agree to indemnify and hold Light Flight Balloons, Inc. and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Light Flight Balloons, Inc. arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
    
8. Severability
   In the event that any provision of this Agreement is declared by any judicial or other competent authority to be void, voidable, illegal or otherwise unenforceable or indications of the same are received by either you or us from any relevant competent authority, we shall amend that provision in such reasonable manner as achieves the intention of the parties without illegality or, at our discretion, such provision may be severed from this Agreement and the remaining provisions of this Agreement shall remain in full force and effect.
    
9. Applicable Law and Dispute
   This Agreement and all matters arising from it are governed by and construed in accordance with the laws of the United States, whose courts shall have exclusive jurisdiction over all disputes arising in connection with this Agreement and the place of performance of this Agreement is agreed by you to be the United States.
    
10. Headings
    Headings are included in this Agreement for convenience only and shall not affect the construction or interpretation of this Agreement.
     
11. Entire Agreement
    These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to these terms and conditions, you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.
     

 Light Flight Balloons, Inc. reserves the right to add, delete, or modify any provision of this Terms, Conditions, and Policies Agreement at any time without notice.
